3/19/07: The this bill was only introduced today
and hasn't even hit the Legislature's
website. We haven't analysed it yet, but already the vibe in Family Court is that this is
bad for kids. We don't yet know who is pushing this bill. Senator Horsford, who is sponsoring the bill, comes from a inner city district of Las Vegas (centered at Lake Mead and Martin Luther King Boulevards), where presumably there are a lot of abuse/neglect cases and a disproportionate number of children taken from their parents. He may be under pressure from his constituents to have less kids taken away. By "raising" the standards under which children are taken from the parents, we would be lowering the protection for children. For example, if child's mother was doing drugs two days ago, but is not high when CPS arrives, then CPS might not be able to take the kid under the new law, because the kid is not in "imminent danger." The current standard for removal is lower: "immediate action is necessary to protect the child from injury, abuse or neglect." Under the current law, CPS is more free to see the totality of the circumstances, not just the immediate danger. If it can be shown that this bill gives less protection to kids then the current law, then maybe we could call it the "KID KILLER BILL" or maybe even.... |
