The issuing of a TPO is a civil matter, based chiefly on the discretion of the judge, but if it is violated, it becomes a criminal offense. When the parties are married, then the TPO court may make temporary arrangements for spousal support, division of property and child custody until a divorce is filed. Thus, the TPO system is sometimes called, "the poor man's divorce court."
